If the user has an active user upgrade, most likely will check active subscriptions only, so the expired subscriptions icon is useless in this case. However, the user still able to check expired upgrades from upgrades page.

No, it should provide a discount if the user has an active/expired subscription. You may add a checkbox option to specify whether it is for active upgrades only or includes expired as well.
I suggest adding the following user criteria.
User has active user upgrades
User has no active user upgrades
User has a user upgrade expiring within the next X days
User has at least X expired user upgrades
User has no more than X expired user upgrades
User has at least X active user upgrades...
